The UN Security Council had by the time of the invasion fixed Iraq with international responsibility for violating international peace and security. Therefore the invasion was not aggressive contrary to jus cogens.
After the invasion the Security Council condoned the invasion and branded the Ba&#039;athist regime as criminal. So did the new government of Iraq, which both the UN and the international community recognise as legitimate. Therefore there is no basis for a charge of aggression either as to state responsibility, or as to criminality.
